Major Changes In Workers' Compensation - Senate Bill 863
Under Senate Bill 863, California’s workers’ compensation laws underwent major changes. In the next several weeks, I am going to be talking about some important changes, and about how these changes may impact an injured worker's claim. The first topic I am going to talk about relates to one of the most important workers’ compensation benefits, medical treatment. This has always been a big issue in the workers’ compensation arena as the law requires that the injured worker be provided with medical treatment that is reasonably required to cure and relieve him or her from the effects of the injury. What constitutes “reasonably required” is often disputed and litigated. The next article will discuss the process of how a medical treatment request by an injured workers' doctor is approved and denied by the insurance carrier, and the process for appealing medical treatment denials.
